    This informative CLE course will present recent malpractice trends in the dental industry such as frequency, awards and other types of claims against dentists. The course will address issues such as standard of care, informed refusal and informed consent.

    The course will also delve into why patients tend to sue their dentists and will also survey tort reform, particularly the limits on non-economic and special damages. The course will also recommend effective early resolution strategies short of trial in light of the low monetary value of most dental malpractice actions.

  • Instructor Bio

    Michael Kowalski

    Dr. Kowalski is a senior trial attorney in the California healthcare defense firm of Bradley, Curley, Barrabee & Kowalski, P.C. After graduating from San Francisco State University with a B.A. in Psychology with a Minor in Chemistry, he obtained his D.D.S. and Bachelor of Science in Dental Materials degrees from the University of California, San Francisco and then practiced dentistry for several years. He obtained his J.D. degree from Santa Clara University School of Law.

    He has been a Trainer with the East Bay AIDS Education & Training Center in Alameda County, where he taught continuing education programs to dentists and dental hygienists regarding HIV disease awareness and infection control techniques and for which he received a Resolution of Commendation from the Alameda County Board of Supervisors.

    He has lectured and authored numerous peer reviewed professional journal articles and textbook chapters in the areas of risk management, professional liability and dental licensing issues. He is a Member of the American Dental Association, California Dental Association, Southern Alameda County Dental Society. As a trial attorney, he has been defending health care providers for over 22 years primarily in the areas of professional liability, administrative licensing board actions, business law and estate planning.
