    ERISA, the Employee Retirement Income Security Act of 1974, presents an administrative process whose complexity necessitates both experience and specific procedural knowledge. Combining h federal regulations, insurance law and more traditional contract litigation, the process contains a variety of legal hurdles that the less experienced will not know how to address. This CLE course will explain how to distinguish between types of disability coverage as well as the process for attacking claim denials in the midst of an appeal. The course will also prepare you for the type of federal litigation unique to ERISA.

    Jason Newfield

    Jason A. Newfield is a founding partner of Frankel and Newfield, P.C., in Garden City, New York, where he devotes his entire practice to aggressively representing claimants in disability insurance claims and litigation, including ERISA, private and governmental policies of short and long term disability, life and health plans.

    Mr. Newfield litigates cases throughout the country on behalf of aggrieved claimants. He has been involved in a host of published decisions from Courts throughout the United States, from both state and federal courts. Jason has received an AV rating from Martindale Hubbell and has been selected as a Super Lawyer from 2013-2019.

    He has authored numerous articles for medical journals and advocacy groups, including the CFIDS Chronicle, Interstitial Cystitis Newsletter, Podiatry Management, and Chiropractic Economics, and served for four years as a member of the Chronic Fatigue Syndrome Advisory Committee, a federal committee which advises the US Department of Health and Human Services regarding Chronic Fatigue Syndrome, a medical condition of particular passion to him.

    Mr. Newfield is also a frequent lecturer to medical organizations about the disability claims process, and has been a Physician Educator to medical providers for Chronic Fatigue Syndrome patients. Mr. Newfield is an annual presenter at the American Conference Institute - Disability Claims conferences, and has been a lecturer for ALI-ABA regarding the claim process for LTD claims.

    He received his J.D. from Hofstra University School of Law, where he was a member of the Hofstra Law Review. Mr. Newfield is admitted to practice law in the states of New York, Pennsylvania and Connecticut, the federal courts of the Southern and Eastern Districts of New York, District of Connecticut and Eastern District of Pennsylvania, the Second and Fourth Circuit Courts of Appeal, and the U.S. Supreme Court.
