About This Course
The EB-5 Immigrant Investor Program continues to serve as an important source of financing for qualifying U.S. development projects while providing eligible foreign investors with a pathway to permanent residency. This CLE program examines the legal and practical considerations attorneys should understand when advising clients involved in EB-5 transactions. Participants will explore the program's current statutory and regulatory requirements, including significant changes introduced by the EB-5 Reform and Integrity Act of 2022, as well as the immigration process that affects both investors and project sponsors.
The course will also discuss how EB-5 financing is integrated into real estate and development projects, including capital stack considerations, job creation requirements, and the roles of regional centers, developers, investors, lenders, and other transaction participants. In addition, the program will review the securities law implications of EB-5 offerings, cross-border compliance issues, and source-of-funds documentation. Attorneys will gain practical insights into the legal risks, transactional issues, and regulatory requirements that arise throughout the lifecycle of an EB-5 investment.
