The legal issues surrounding workplace vaccination requirements continue to evolve as employers, employees, and government regulators navigate the lasting effects of the COVID-19 era. Although many emergency vaccination requirements have ended, the litigation and regulatory developments of recent years continue to influence how vaccination policies are evaluated under employment, constitutional, and state law.

This CLE course will provide an overview of the legal considerations involved in implementing, challenging, and enforcing workplace vaccination requirements. The program will address the legal authority underlying vaccination mandates, including the respective roles of federal agencies, state governments, and private employers. It will also examine federal employment protections applicable to employees seeking medical or religious accommodations, state restrictions and requirements affecting employer policies, and developing approaches to disputes involving vaccination requirements.

Additional topics will include employer liability, recent litigation and emerging legal trends, and available remedies for individuals alleging vaccine-related injuries. The program is designed to help counsel assess vaccination policies and advise employers and employees as the law continues to develop.
