For years, Pennsylvania practitioners have grappled with a murky standard for preliminary hearings, uncertain about just how much evidence was needed to proceed. That ambiguity has now ended. In a decisive opinion, the Pennsylvania Supreme Court has settled the debate, holding that hearsay alone cannot satisfy the burden of proof at this stage of a criminal case.
