About This Course
This CLE course offers a practical examination of labor and employment arbitration through the lens of an experienced arbitrator, providing attorneys with insight into how cases are assessed and decided throughout the arbitration process. From case preparation and issue framing to hearing strategy and final decision-making, participants will gain a clearer understanding of the factors that influence outcomes and effective advocacy techniques in arbitration proceedings.
The program reviews the evolution of labor-management relations and the development of grievance systems, collective bargaining structures, and disciplinary procedures before exploring core arbitration concepts, including grievance, disciplinary, and interest arbitration. Attendees will also examine critical topics such as the “just cause” standard, progressive discipline, burdens of proof, evidentiary and procedural challenges, witness presentation, and hearing management in both virtual and traditional settings. The course additionally addresses statutory disciplinary frameworks and available remedies, while offering insight into how arbitrators evaluate evidence and draft well-reasoned awards.
