About This Course
This CLE program provides a practical overview of modern DUI defense litigation, with particular emphasis on Illinois law and key distinctions between Illinois procedures and approaches used in other jurisdictions. The course examines how developments in constitutional law, evidentiary issues, and pretrial strategy can affect the defense of impaired driving cases from initial arrest through trial.
Attendees will explore challenges involving field sobriety testing, breath-test evidence, dash-camera requirements, and the expanding role of video footage in analyzing Fourth Amendment issues. The program will also address important pretrial advocacy tools, including motions to suppress evidence, motions to quash arrest, and procedures related to Petitions to Rescind Summary Suspension.
Beyond motions practice, the course offers practical guidance on discovery strategy, client counseling, expert use in medically related defenses, trial preparation, and navigating collateral consequences. Participants will also review influential Illinois decisions, including Patel and Trainor, while examining broader trends and defense strategies emerging across jurisdictions.
