The aging of the American population is reshaping the landscape of estate, probate, and fiduciary litigation. As older adults control an increasingly significant share of personal wealth, courts are seeing a growing number of disputes involving alleged incapacity, undue influence, breach of fiduciary duty, contested estate planning documents, and claims of elder financial abuse.
