    Practitioners do not typically address pre-mortem planning which presents a hosts of issues that are critical. This CLE course will review all the critical factors such as monitoring and proper exercise of swap powers for clients with irrevocable grantor trusts as well as remaining gift and GST exemptions, discounts for taxable estates and revisions to FLP and LLC governing documents to eliminate discounts on smaller estates are all issues that need to be thoroughly understood by practitioners. These differ greatly from post-mortem planning which varies for decedents subject to estate tax and those not. Valuation discounts, estate inclusion and the factor of estate size as well as portability, for 8971, estate tax deferral and closing letters will all be discussed.

    Martin M. Shenkman, CPA, MBA, PFS, AEP (distinguished), JD, is an attorney in private practice in Paramus, New Jersey and New York City. Practice concentrates on estate and tax planning. He is the author of 42 books and more than 1,000 articles. He is active in many charitable causes and founded ChronicIllnessPlanning.org which educates professional advisers on planning for clients with chronic illness and disability. He has a Bachelor of Science degree from Wharton School, with a concentration in accounting and economics, an MBA from the University of Michigan, with a concentration in tax and finance, and a law degree from Fordham University School of Law.
