About This Course
Planning for long-term care requires careful consideration of Medicaid rules, tax consequences, and the ownership and transfer of real property. This CLE program will address strategies for navigating Medicaid eligibility requirements while protecting assets, including residential real estate and other investments. Topics will include long-term care funding options, Medicaid application procedures, income and resource limits, transfer penalties, exemptions, and the circumstances in which Medicaid liens may arise.
The presentation will explore estate planning techniques for preserving property and maintaining control over assets, including the use of revocable and irrevocable trusts, life estates, transfer-on-death deeds, and joint ownership. Attendees will also examine the tax implications of various planning structures, with a focus on grantor trust rules, fiduciary income tax rates, capital gains, estate inclusion, and basis adjustments at death. The program will further address supplemental needs trusts, planning with retirement accounts, pooled income trusts, and issues that arise when rental property generates income that affects Medicaid eligibility.
