About This Course
This CLE examines the challenges attorneys face when business relationships, ownership interests, property rights, and financial arrangements are created through informal agreements or incomplete documentation. Using the Napkin Litigation Framework™, the program provides a practical methodology for analyzing these disputes, developing an evidentiary record, and transforming competing narratives into legally supportable claims.
The course will address strategies for conducting effective client intake, identifying and distinguishing ownership, economic, control, and exit rights, and evaluating disputes across multiple areas of law. Participants will explore the Framework’s four phases—Asset, Control, Money, and Claim—and the twelve protocols designed to organize the facts, evidence, and legal theories necessary to advance complex business disputes.
A fictional $15 million dispute will serve as a case study throughout the program, allowing attendees to apply the framework to issues involving fragmented records, conflicting claims, technology-assisted evidence analysis, and competing economic interests. The course will also consider strategies for pursuing remedies that produce meaningful and enforceable economic outcomes rather than merely obtaining paper judgments.
