About This Course
This CLE program explores key environmental issues that arise in business transactions and examines the legal complexities involved in environmental disputes and litigation. The transactional portion will focus on environmental due diligence considerations, including the scope and timing of environmental investigations, strategic considerations regarding whether buyers or sellers should conduct such assessments, and potential disclosure and reporting obligations stemming from investigative findings.
The program will also address how parties allocate environmental risk when contamination is discovered, including negotiating and drafting provisions related to remediation responsibilities, liability allocation, indemnification obligations, and contractual risk-shifting mechanisms.
