About This Course
Section 1031 exchanges offer real estate investors a powerful opportunity to defer capital gains taxes and preserve investment capital, but even minor missteps can jeopardize the transaction. This practical CLE provides attorneys with a working understanding of the exchange process and the key issues that arise during planning, structuring, and closing.
Participants will explore the requirements for a valid exchange, including like-kind property rules, identification deadlines, qualified intermediary involvement, boot, debt replacement, related-party transactions, reverse exchanges, and common ownership and partnership challenges. The program also examines replacement property options such as Delaware Statutory Trusts (DSTs) and triple-net (NNN) investments. Attendees will leave better equipped to recognize exchange opportunities, advise clients effectively, and avoid pitfalls that can result in unexpected tax consequences.
