Pretrial practice in criminal cases is often narrower in scope than in civil litigation, but it remains a critical component of an effective defense strategy. When used deliberately, pretrial motions can do far more than resolve discrete legal issues—they can shape the trajectory of a case from its earliest stages.
This CLE program examines how criminal defense attorneys can approach pretrial litigation with greater strategic intent. It highlights the value of motion practice beyond simply winning or losing, demonstrating how even unsuccessful motions can strengthen the defense by preserving appellate issues, developing a favorable record, influencing prosecutorial decision-making, and framing key arguments for the court.
