About This Course
This CLE program explores a structured methodology for preparing patent applications that can withstand eligibility scrutiny under 35 U.S.C. § 101. Taught by a patent attorney and former USPTO examiner from Business Methods Technology Center 3600, the session adapts project-management principles to the realities of patent drafting and prosecution.
The course highlights practical techniques practitioners can implement immediately, drawing on current USPTO guidance such as the August 2025 examiner memo, Director Squires’ precedential ruling in Ex parte Desjardins, and updated USPTO time-allocation practices. As eligibility standards continue to shift, attendees will learn how to build applications that better articulate technical substance, reduce vulnerability to § 101 rejections, and more effectively anticipate and address examiner objections.
