About This Course
This CLE program examines the practical and legal challenges attorneys face when handling matters involving Medicare’s interests in litigation and settlement proceedings. Focusing on the requirements of the Medicare Secondary Payer (MSP) framework, the course will provide attorneys with a current and practical understanding of compliance obligations, reimbursement issues, and risk mitigation strategies that arise in personal injury and liability cases.
Designed for both plaintiff and defense practitioners, the program will address key aspects of MSP compliance, including Section 111 reporting obligations, potential exposure to Civil Money Penalties, and the resolution of Medicare Conditional Payment claims involving traditional Medicare, Medicare Advantage plans, and Medicare Part D prescription drug coverage. The course will also explore the role of Medicare Set-Asides (MSAs) in protecting Medicare’s future interests and reducing the risk of improperly shifting medical costs to the federal government.
In addition, participants will review effective approaches for communicating and negotiating with CMS and Medicare Advantage organizations, methods for tracking and documenting conditional payment information, and recent developments in case law, enforcement trends, and regulatory guidance impacting MSP obligations. The program is intended to equip attorneys with practical tools to navigate settlements efficiently while maintaining compliance in an increasingly complex regulatory environment.
