About This Course
This CLE program offers a targeted examination of FinCEN’s Residential Real Estate Reporting Final Rule and the resulting considerations for attorneys and compliance professionals. It opens with a survey of the federal anti-money laundering (AML) regime, highlighting the governing statutes, the functions of FinCEN and OFAC, and the application of Geographic Targeting Orders in overseeing real estate activity.
The faculty will then analyze the architecture of the Final Rule, addressing which transactions fall within its scope, the nature of reporting requirements, available exemptions, and key defined terms such as reporting persons and beneficial owners. Attention will also be given to the evolving legal environment, including recent court decisions bearing on the rule’s implementation and related FinCEN guidance.
The program concludes with a practical focus, outlining actionable compliance approaches, methods for evaluating risk exposure, and recommended practices to help legal and industry professionals remain prepared amid regulatory uncertainty, particularly if reporting obligations are reactivated.
